Terms of Service

These terms explain how you may use the Emberose website and purchase jewellery from us. They sit alongside our Shipping Information, Returns & Warranty Policy and Privacy Policy.

About these terms

This website is operated by Emberose Jewellery Pty Ltd (ABN 83 701 058 362). By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website or place an order.

Nothing in these terms excludes, restricts or modifies rights you have under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Products, images and availability

We take care to present each piece accurately. Jewellery may vary slightly in colour, scale, gemstone appearance and finish because of screen settings, photography, hand finishing and the natural characteristics of gemstones. Reference images and descriptions are a guide, not a promise of an identical appearance where a piece is made to order or custom created.

Availability, pricing and product details may change. If there is an obvious error in a listing, price or availability, we may correct it and contact you to discuss the next step, including cancellation and a refund where appropriate.

Pricing and payment

All prices are in Australian dollars and include GST unless clearly stated otherwise. Full payment is required at checkout for Ready to Ship, Made to Order and complete custom pieces. Your order is subject to payment authorisation and our acceptance.

Flexible payment options

Once activated, Zip will be available only for eligible Ready to Ship pieces. Zip will not be available for gift cards, Made to Order pieces, complete custom pieces, pre-orders or back-ordered products.

Approval, account limits and repayment arrangements are determined by Zip. Any approved refund will be returned through the original payment method, subject to our Returns & Warranty Policy and your rights under the Australian Consumer Law.

Made to Order and complete custom pieces

Made to Order pieces are typically created and dispatched within 3–5 weeks. Complete custom pieces are typically created and dispatched within 5–7 weeks. In some cases a custom piece may be expedited to around 4 weeks, but this must be confirmed with us before ordering.

You may cancel a Made to Order or complete custom order within 3 days of placing it, provided it is not a rush order and production or procurement has not already commenced. Rush orders cannot be cancelled. This cancellation position applies to change-of-mind requests and does not affect rights you may have under the Australian Consumer Law.

For custom work, you are responsible for reviewing and approving the agreed design details before we proceed. You confirm you have the right to provide any reference images or material you send us.

Ring sizing

You are responsible for selecting the correct ring size before ordering. Please use our Ring Size Guide or obtain professional sizing from a local jeweller. We do not currently offer a resizing service. This does not limit any remedy available under the Australian Consumer Law where goods do not meet a consumer guarantee.

Delivery, returns and warranty

Delivery timeframes, free-shipping eligibility, signature requirements and delivery-issue steps are set out in our Shipping Information. We currently ship within Australia only.

Change-of-mind returns, exchanges and the voluntary 12-month manufacturing-defect warranty are set out in our Returns & Warranty Policy. That policy does not limit your rights under the Australian Consumer Law.

Website use and intellectual property

All website content, including imagery, designs, words, branding and layout, is owned by or licensed to Emberose Jewellery and may not be copied, reproduced, modified or used commercially without our written permission. You must not use the website for an unlawful purpose or interfere with its operation or security.

Third-party services and links

Our website is hosted on Shopify and may link to third-party websites or services. Those providers have their own terms and privacy practices. We are not responsible for their content or operation, except where responsibility cannot be excluded by law.

Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the website. This does not exclude liability that cannot lawfully be excluded, including your rights and remedies under the Australian Consumer Law.

Changes and governing law

We may update these terms from time to time by publishing the updated version on this page. The terms in effect when you place an order apply to that order, unless a change is required by law or we agree otherwise.

These terms are governed by the laws of Victoria, Australia. The courts of Victoria, Australia have non-exclusive jurisdiction in relation to disputes connected with these terms.
